- The JAMES 1:27 TRUST, Trust duly incorporated in terms of the laws of the Republic of South Africa, with Registration No:10446/04, PBO No: 930024712, and NPO No:041 353, with address of 421 Trevor Gething Str, Garsfontein, Pretoria, 0181, owns and operates the website https://www.james127trust.org/ (hereinafter referred to as the ‘Trust’, ‘Website’, ‘we’ or ‘us’.)
- Here JAMES 1:27 TRUST lists the policies regarding the collection, use, and disclosure of Personal Information when you access our website or when you Sponsor a care program or project and the choices you have associated with that information. We use your information to provide and improve the website and our campaigns. By donating as a sponsor, you agree to the collection and use of information in accordance with this Privacy Policy.
- DEFINITIONS
- ‘Campaign(s)’ – Means news, announcements, family stories, alerts or similar information to be emailed to you from the JAMES 1:27 TRUST. This also includes posts on Social Media platforms which will not include Personal Information.
- ‘Cookies’ - Cookies are small pieces of data stored on your device (computer or mobile device).
- ‘Data’ - Means data collected automatically. Either generated by your use of the Website, or your donations as a Sponsor and you entering certain information, or from the Website infrastructure itself which may include Personal Information.
- ‘Data Processors’ - means any natural or legal person who processes the Data on behalf of the Responsible Party. We may use the services of various Data Processors to process your data more effectively.
- ‘Data Subject (includes a Sponsor)’ - means any living person or juristic person who is using our Website, is subscribing to receive our Campaigns, or is a Sponsor and is the subject of Personal Information. This also includes the living individual e.g. an employee of Sponsor, of whom Personal Information is being collected on the website.
- ‘Personal Information’ - means Data about a living individual (you) who can be identified from those data (or from those and other information either in our possession or likely to come into our possession), such as your name, contact details, your business details, Sponsorship history and the like information listed in paragraph 3.2. This is in conformance with and includes by reference the definition of Personal Information under the Protection of Personal Information Act, No. 4 of 2013. It may also contain information about how you use our Website.
- ‘Responsible Party’ - Responsible Party means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information is, or is to be, processed. For the purpose of this Privacy Policy, JAMES 1:27 TRUST is the Responsible Party of your Personal Information or Data.
- ‘Sponsor’ – Means you, your business or organisation, whether a natural or juristic person, to whom we distribute our Campaigns and who may donate through our Website.

We collect different types of information to provide and improve our service to you.
PERSONAL INFORMATION AND DATA
- While subscribing to receive our Campaigns or making a donation as a sponsor, we may ask you to provide us with certain Personal Information that can be used to contact or identify you or your staff members.
- Personal Information may include, but is not limited to:
- Information relating to your ID Number, Company Registration number if applicable, Date of Birth, Names, Address, and Email Address; and
- Information relating to your donations as a Sponsor which includes tax number, amounts donated, bank details for purposes of debit order, credit card details to process a donation, and related information to process your donation and provide a tax deductive receipt;
- Any identifying number, symbol, employee number, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to you;
- Your private or confidential correspondence (including correspondence that can reveal your original private or confidential correspondence) and the views or opinions of another individual about you; and
- Your name if it appears with your other personal information or if your name itself would reveal information about you.
CAMPAIGNS
- If you subscribe to receive our Campaigns, we will hold your details on our database until such time as you chose to unsubscribe from our Campaigns. During the subscription, we may use your Personal Information to contact you regarding your profile, perform market research, contact you with newsletters, announcement emailers, stories of Trust families or promotional materials and other information that may be of interest to you or us. You may opt out of receiving any, or all, of these promotional communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us at communications@james127trust.org.
DATA
- We may also collect information on how our Website is accessed and used and how Data is entered. This Data may include information such as your computer's Internet Protocol (IP) address, operating system, browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. This information may be used for system administration purposes and to report aggregate information to our webmasters or developers. It is statistical data about our website users' browsing actions and patterns which does not identify any individual and allows us to ensure that content from our Website is presented in the most effective manner for you and for your computer.

- To gather analysis or valuable information so that we can improve our Website or Campaigns;
- To monitor the usage of our Website;
- To detect, prevent and address technical issues;
- To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already used or enquired about unless you have opted not to receive such information; and
- Demographical and statistical information about Data Subject behavior may be collected and used to analyze the popularity and effectiveness of our website or Campaigns. Any disclosure of this information will be in aggregate form and will not identify individual Data Subjects.
- Personal information will not be sold to third parties, nor provided to direct marketing companies or other such organisations without your permission. We may disclose your personal information to third parties if we are under a duty to disclose or share such information, where required by law.
- RETENTION OF PERSONAL INFORMATION AND DATA
We will retain your Data and Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. - TRANSFER OF PERSONAL INFORMATION AND DATA
- Your Data may be transferred to, and maintained on, servers or physical storage located inside of South Africa.
- Please note that we may transfer Data and Personal Information, to the locations of our third-party Data Processors' servers and it may be processed there. This will ordinarily be inside South Africa (for instance, Netcash). However, our Campaigns, which make use of a Sponsor’s email address, are distributed through a third party service provider named ‘MailChimp’, located in the U.S.A whose terms and conditions under which they may process Personal Information provide for the protection and integrity of the Personal Information.
- Your consent to this Privacy Policy followed by your submission of such Personal Information represents your agreement to that transfer and that such transfer is necessary for the performance of the contract between us.
- We will take reasonable steps to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Information will take place to a data processor unless there are adequate controls in place including the security of your Data and other Personal Information.
- It is not reasonably possible for us to monitor the location from which a Sponsor or Data Subject may access their Personal Information provided by the Website. For instance, a Sponsor opens an email and views their receipt overseas. Should you, as a Data Subject of Sponsor access your Personal Information while not within South Africa, we make no representations as to the protection which may be offered to your Personal Information in that foreign country. In this scenario, Sponsor consents to the processing of your Personal Information, in a foreign country, or transferring it to a foreign country whose laws regarding processing of personal information may be less stringent than those in South Africa. We recognize that the transfer, when it happens, is necessary for the performance of the contract between us, or for the implementation of pre-contractual measures taken in response to your request.
- DISCLOSURE OF DATA
Legal requirements may require us to disclose your Data, however, this is done in good faith and with the belief that such action is necessary:
- To comply with a legal obligation;
- To protect and defend the rights or property of the JAMES 1:27 TRUST;

- These Data Processors have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. The Data Processors are under contractual obligations, with us, to protect your Personal Information.
- LINKS TO OTHER SITES
- Our Website and our Campaigns may contain links to other sites that are not operated by us. If you click on a Third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.
- We have no control over and assume no responsibility nor any liability for the content, privacy policies or practices of any third party sites or services.

- APPLICABLE LAWS
This Privacy Policy is governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts or the dispute resolution mechanisms provided by the Information Regulator, in respect of any dispute which may arise out of or in connection with the formation, interpretation, substance or application of this Privacy Policy.
